Destiny 2: Vesper’s Host - Dungeon Podium Race Official Rules
Anyone participating in or wishing to participate in the Destiny 2: Vesper’s Host Dungeon Podium Race (the “Promotion”) is referred to in these Official Rules as an “Entrant”. Participation in the Promotion constitutes Entrant’s full and unconditional agreement to accept and abide by these Official Rules.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR TO WIN. PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.

PROMOTION PERIOD: The promotion begins October 11, 2024, at 10:00AM Pacific Time and ends when the first three fireteams successfully completes the dungeon (the “Promotion Period”). Anyone eligible and participating or wishing to participate in the Promotion is referred to in these Official Rules as a “Participant.” The dates and times specified in these Official Rules are based on Pacific Standard Time. Participants will be subject to the local time and date as applicable of the participating country/region based on their residence.

SPONSOR: The company responsible for running the Promotion is the Sponsor.

- Sponsor’s decisions with regard to the Promotion and these Official Rules are final and binding in all respects.

ELIGIBILITY: The Promotion is open only to Entrants who meet the eligibility requirements listed below as of the start of the Promotion Period (defined in Section 3):
- 4.1. Must be at least 13 years of age.
If any person is or will be under the age of legal majority where they live at the start of the Promotion Period (defined in Section 1), they must:

- (1) obtain permission from their parent or legal guardian in order to participate in the Promotion; and
- (2) their parent or guardian must agree to these Official Rules on their behalf.
Sponsor may ask for written proof of the parent or legal guardian’s permission and agreement as a condition of awarding any prize to a person who is under the age of legal majority.
- 4.2. Must own a valid copy of Destiny 2, the Final Shape Dungeon Key.
- 4.3. Exclusions: Entrants cannot be (a) an employee of the Sponsor, or one of its parent companies, affiliates, subsidiaries, or related companies and agencies; or (b) an immediate family member (defined as their parents, children, siblings and spouse and their respective spouses, regardless of where they live), or living in the same household of as anyone in category (a), whether or not related to them.

- HOW TO ENTER: During the Promotion Period, assemble a Fireteam of three players and start the Vesper’s Host dungeon in Contest Mode from the planet system map. All of the Fireteam members must have completed the necessary in-game requirements to be able to access the activity.
After the activity has started, the Fireteam must complete the miscellaneous objectives and encounters. Once the final encounter is complete, the Fireteam must loot the final chest or their finish may not be recorded. A team's official finish will be recorded when they loot the final chest.
There is no limit for the number of times a Participant may attempt the activity.
- HOW TO WIN: The first three Fireteams to complete the Vesper’s Host dungeon in Contest Mode will be declared winners in a post by @DestinyTheGame on X. For purposes of the Promotion, the authorized account holder of the Bungie.net account used to enter the Promotion is the “Entrant”. The “authorized account holder” is the natural person assigned to an email address by an internet access provider, online service provider, or other organization responsible for assigning email addresses. Potential Winners may be required to show proof of being the authorized account holder as a condition of receiving their respective prizes.
At least one member of the fireteam must have completed and received loot for every encounter and it must be the first time completing the activity for all members of the fireteam.
If a Fireteam cycled through different members during their attempt, the final Fireteam members remaining upon the completion of the final encounter of the dungeon will be declared the winners and be awarded the Prize.
As the contest is skill-based, the odds of winning depend on the total number of eligible participants and the participant’s performance.

- The ARV is provided in U.S. Dollar (pre-tax cash value). Where applicable, Eligible Participants should refer to the converted value in their relevant local currencies.
- 8.1. Prize Fulfillment: Physical prizes will be delivered to Confirmed Winners at the physical address provided during the winner verification process. Prizes may take approximately 8 months to fulfill due to the time needed for creation and customization of the Prize. Physical addresses for Prize delivery must be located in the Participating Country/Region in which the Confirmed Winner is a legal resident of. The Prize delivery period may be extended due to customs processing delays or other delays outside of the control of Sponsor.
- 8.2. Taxes and Costs: All prizes listed above represent the prize amount before taxes. Winners are solely responsible for any applicable taxes, fees, expenses, or other costs associated with winning or the prizes they receive. We recommend that you consult with a tax advisor if you have questions about what tax liabilities may arise from winning a prize in this Promotion. The value of any prize awarded to a winner may be reported for tax purposes as required by law.
- 8.1. Prize Fulfillment: Physical prizes will be delivered to Confirmed Winners at the physical address provided during the winner verification process. Prizes may take approximately 8 months to fulfill due to the time needed for creation and customization of the Prize. Physical addresses for Prize delivery must be located in the Participating Country/Region in which the Confirmed Winner is a legal resident of. The Prize delivery period may be extended due to customs processing delays or other delays outside of the control of Sponsor.
Participants who reside in the United States and win a prize valued at or above $600 will be required to complete an IRS form W-9 as a condition of receiving the prize. Winners of prizes hereby release Sponsor and any of its subsidiaries from any responsibility for the payment of any local and federal taxes and/or any other fees arising out of the acceptance and receipt of prizes.
For Participants who reside in Taiwan: According to the Income Tax Act, if the value of a prize won in a lottery exceeds NTD 1,000, it will be included in the individual’s annual comprehensive income tax declaration. If the total prize value exceeds NTD 20,000, a 10% prize tax will be withheld. For individuals who do not reside in Taiwan for more than 183 days (this includes both Taiwanese and foreigners), a 20% lottery tax will be deducted regardless of the prize amount won. If the tax to be withheld is less than NTD 2,000, it will be exempted (this exemption does not apply to foreigners). If the winner refuses to pay the withheld tax after being notified by the Sponsor, the winner will be considered to have forfeited their prize. No subsequent prize replacements will be made.
For Participants who reside in South Korea: Winners who reside in South Korea and win a prize valued at or above KRW 50,000 will be required to pay 22% tax as a condition to receiving the prize.
For Participants who reside in Thailand: Winners who reside in Thailand and win a prize valued at above THB 1,000 will be required to pay 5% withholding tax as a condition to receiving the prize.

- 8.3. No substitutions by Participant, no warranties: Prizes are non-transferable and no request for prize substitution or exchange by Participant will be allowed or honored. Participant may forfeit their prize if they do not want it. Sponsor reserves the right to substitute a prize of equal or greater value in case of unavailability of the prize or force majeure, at Sponsor’s sole discretion. All prizes are provided “as is” without warranty of any kind, either express or implied, and Sponsor hereby disclaims all such warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose and/or non-infringement.
- 8.4. Forfeited Prizes: Return of any prize notification message as undeliverable will result in forfeiture of the applicable prizes. If a prize is forfeited for any reason, such prize will not be awarded.
- 8.5. Winner Notification, Verification and Required Documentation: Participants who are eligible for a Prize under Section 6 will be considered “Potential Winners” until the winner successfully completes the verification process, at which time they will be considered “Confirmed Winners” and eligible to receive a prize. Potential Winners will be notified of their prizes via (i) a direct message on X, or (ii) a notification on Bungie.net. To be considered a Confirmed Winner, Potential Winners must comply with these Official Rules and the applicable Participating Tournament Ruleset, and within 14 days (the “Verification Window”), may be required to provide their shipping address, a completed declaration of eligibility and liability release, and a completed tax form, in accordance with the instructions listed in the notification correspondence, as a condition of receiving a prize. If a Potential Winner fails to provide true and complete information to Sponsor within the Verification Window, the Prize will be deemed forfeited and Sponsor will not have any obligation to deliver the Prize to the Potential Winner. If a Potential Winner is considered a minor in the legal jurisdiction in which the Participant resides, then that Participant’s parent or legal guardian may be required to execute and return the Declaration. In addition, Participants from Canada may be required to correctly answer, unaided, a time-limited mathematical skill-testing question at a pre-arranged, mutually convenient time prior to being confirmed a prize winner. Potential Winners may be disqualified and forfeit their respective prizes if (a) Sponsor determines that they do not meet all eligibility requirements; (b) they fail to provide any required documentation by the stated deadline; (c) they cannot be reached at the email address associated with Participant’s account within a reasonable time period, as determined in Sponsor’s sole discretion; (d) their account is no longer active at the time Sponsor attempts to notify them or award them their prize; (e) Sponsor determines they violated the Code of Conduct; or (for Canada only) (f) they fail to correctly answer the required math skills question. Sponsor’s decisions are final and binding in all matters related to the Promotion.
- 8.6. Prize Acceptance. By accepting a Prize, the Confirmed Winner agrees to release Sponsor from any and all liability, loss or damage arising from or in connection with awarding, receipt and/or use or misuse of such Prize or participation in any Prize-related activities. Depending on the Prize, other terms and conditions may apply to such acceptance and use of such Prize.
- 8.3. No substitutions by Participant, no warranties: Prizes are non-transferable and no request for prize substitution or exchange by Participant will be allowed or honored. Participant may forfeit their prize if they do not want it. Sponsor reserves the right to substitute a prize of equal or greater value in case of unavailability of the prize or force majeure, at Sponsor’s sole discretion. PUBLICITY: To the extent permitted by applicable law, by participating in this Promotion, each Entrant gives the Sponsor a free, non-exclusive, perpetual, worldwide license to use their name, image, likeness, in-game identifiers (e.g., Bungie Name), avatar and any other biographical or other information or content provided to Sponsor in connection with the Promotion, in all media for any lawful purpose, including for purposes of advertising or trade.
The Sponsor will not make any further payment to the Entrant, and use of these permissions will be without Entrant’s further notice, review, or approval.
All permissions granted to Sponsor under these Official Rules will still apply after the end of this Promotion unless the Entrant formally cancels this permission by writing to “Legal Department, Legal Notices” at the address for Sponsor provided in Section 2 of these Official Rules.

GENERAL CONDITIONS:
- 10.1. Disqualification. Sponsor has the sole discretion to disqualify any Participant from the Promotion or any other promotion conducted now or in the future by Sponsor or a Sponsor affiliate, in the event Sponsor determines, in its sole discretion, that Participant has: i) violated these Official Rules; ii) tampered with the entry process or the operation of the Promotion; iii) engaged in fraud or misconduct affecting the integrity of this Promotion (including but not limited to use of entries generated by macro, script, bot, or similar method or use of any third-party modifications to a game or game files that give Participant an advantage over other players); iv) engaged in any racist, bullying, harassing, or offensive conduct, or any other activity that would constitute a violation of the Bungie Code of Conduct or Terms of Use; or v) providing false information or data. Entries generated by script, macro or other automated means or with the intent to impair the integrity of the Promotion will be void.
- 10.2. Right to Modify, Suspend or Cancel. Unless prohibited by competent licensing authorities or applicable regulations, Sponsor has the sole discretion to modify, cancel or suspend this Promotion if:
- 10.2.1. Sponsor decides that the Promotion can’t be executed as intended; or
- 10.2.2. any error, omission, fraud, technical failure, tampering, war, public health emergency, viruses, bugs, unauthorized human intervention or other factor, technical or otherwise, beyond Operator’s control impairs or may impair Operator’s ability to properly conduct the Promotion, including maintaining its security and proper play, subject to any applicable law or regulation.
- 10.2.3. In the event of any such cancellation, termination or suspension the Operator may not award any Prizes in connection with the Promotion and reserves the right, in its sole and absolute discretion, to dispose of the Prizes in any manner it sees fit, subject to applicable local laws.
- 10.2.1. Sponsor decides that the Promotion can’t be executed as intended; or
- 10.3. Control of Official Rules. In the event of any inconsistency between these Official Rules and any advertising or other materials relating to the Promotion or the Participating Tournaments, these Official Rules shall prevail.
- 10.4. Severability. If any part of these Official Rules is concluded by an appropriate jurisdiction’s court to be illegal, invalid, or otherwise unenforceable, that part of the rules will be considered to be removed and the rest of these Official Rules shall continue to apply.
- 10.5. Translation. Sponsor may make official translations of these Official Rules available in languages other than English. To the extent allowed by law, in the event of any conflict between the English version of these Official Rules and any translation, the interpretation under the English version shall prevail.
- 10.1. Disqualification. Sponsor has the sole discretion to disqualify any Participant from the Promotion or any other promotion conducted now or in the future by Sponsor or a Sponsor affiliate, in the event Sponsor determines, in its sole discretion, that Participant has: i) violated these Official Rules; ii) tampered with the entry process or the operation of the Promotion; iii) engaged in fraud or misconduct affecting the integrity of this Promotion (including but not limited to use of entries generated by macro, script, bot, or similar method or use of any third-party modifications to a game or game files that give Participant an advantage over other players); iv) engaged in any racist, bullying, harassing, or offensive conduct, or any other activity that would constitute a violation of the Bungie Code of Conduct or Terms of Use; or v) providing false information or data. Entries generated by script, macro or other automated means or with the intent to impair the integrity of the Promotion will be void.

RELEASE AND LIMITATION OF LIABILITY:
- 11.1. Except where prohibited by local law and to the fullest extent permissible by law, by participating in the Promotion each Participant agrees to indemnify, release, and hold harmless the Sponsor, and its respective officers, directors, shareholders, members, employees, agents, parents, partners, subsidiaries, affiliates, advertising and promotional agencies (collectively, the “Released Parties”), from any and all liability or any injury, loss or damage of any kind arising in connection with the Promotion (excluding cases arising from Sponsor’s willful misconduct or gross negligence), including property damage, personal injury and death that may occur in connection with, preparation for, travel to, or participation in the Promotion, or possession, acceptance or use of prizes or participation in any Promotion-related activities and claims based on publicity rights, copyright or trademark infringement, defamation or invasion of privacy, data protection, and merchandise delivery.
- 11.2. To the maximum extent permitted by law, the Released Parties are not responsible for: any incorrect or inaccurate entry information; any changes to Participant’s contact information; human errors; technical malfunctions; lost, stolen, mutilated, mis-delivered, postage due, illegible, incomplete or untimely entries that may limit Participant’s ability to participate in the Promotion, even if caused by Sponsor’s negligence; failures, omissions, interruptions, deletions, or defects of any telephone network, computer online system, computer equipment, servers, providers, or software, including any injury or damage to Participant's or any other person's computer relating to participation or inability to participate in the Promotion; inability to access the site or upload information or data; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer, or electronic malfunction or traffic congestion on telephone lines or the Internet or any website (including the Site) or for any other reason whatsoever; printing or other errors; or any combination thereof. Proof of uploading information or data or entering information at the site is not considered proof of delivery or receipt. Illegible, duplicate and incomplete entries will be disqualified. False, fraudulent, or deceptive entries or acts, as determined by Sponsor, render Participants ineligible and all associated entries will be void. Sponsor is not responsible for technical, hardware or software failures, malfunctions, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmissions or unforeseen schedule changes that may limit a Participant’s ability to participate in the Promotion, even if caused by Sponsor’s negligence.
- 11.3. To the maximum extent permitted by applicable law, in no event will the Released Parties be liable or responsible for any incidental, consequential, or punitive damages arising out of or in connection with the Promotion.
- 11.4. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES (INCLUDING BUT NOT LIMITED TO THE DAMAGES ARISING FROM OPERATOR’S WILLFUL MISCONDUCT OR GROSS NEGLIGENCE); AS A RESULT, CERTAIN OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO PARTICIPANTS WHO ARE RESIDENTS OF THOSE JURISDICTIONS.
- 11.1. Except where prohibited by local law and to the fullest extent permissible by law, by participating in the Promotion each Participant agrees to indemnify, release, and hold harmless the Sponsor, and its respective officers, directors, shareholders, members, employees, agents, parents, partners, subsidiaries, affiliates, advertising and promotional agencies (collectively, the “Released Parties”), from any and all liability or any injury, loss or damage of any kind arising in connection with the Promotion (excluding cases arising from Sponsor’s willful misconduct or gross negligence), including property damage, personal injury and death that may occur in connection with, preparation for, travel to, or participation in the Promotion, or possession, acceptance or use of prizes or participation in any Promotion-related activities and claims based on publicity rights, copyright or trademark infringement, defamation or invasion of privacy, data protection, and merchandise delivery.

COLLECTION OF INFORMATION: Except as otherwise specified, the information collected in connection with the Promotion will be collected in accordance with Sponsor’s Privacy Policy, available at https://www.bungie.net/7/en/legal/privacypolicy.

WINNER LIST: Where required by local law, a list of verified winners may be made available to regulators or to members of the public upon request. Interested people should contact Bungie at CommunityGiveaway@bungie.com.
Any requests for a Winners list by members of the public must be received within 60 days of the close of the Entry Period. If a Verified Winner objects to their name being published or made available, please contact the Sponsor. Please note that notwithstanding any objection, the Sponsor may be obligated to provide this information to regulators or others if required by law.
